Maksym Lavrynovych Describes Trust Management Risks to Business Owners

Lavrynovych & Partners Law Firm held on February 19 a working breakfast with the owners and managers of leading companies; the event was devoted to benefits and drawbacks of informal agreements in business and marriage.

Maksym Lavrynovych, the Firm’s Managing Partner, devoted his report to recent abusive practices committed by trustees, in particular, trusts registered in offshore zones, with regard to assets owned by Ukrainian businessmen. The second part of the report delivered by Maksym Lavrynovych was about efficient methods of protecting businesses in the event of specific force majeure suffered by the owners of such businesses.

Oleksandr Onufrienko, Head of Legal Department at KINTO, an asset management company, who was the special guest of the event, reviewed a series of high-profile hostile takeovers which had occurred in Ukraine and CIS member states over the past two years. Oleksandr Onufrienko went into detail about the Boris Berezovsky vs. Roman Abramovich case at London’s Commercial Court regarding indemnity of losses incurred from the sale of shares in Sibneft and Rusal in 2001-2004, and an attempt of Cyprus lawyers to take over Rosinka group of companies.

Representatives of the business community participated in a lively discussion and received practical advice.
