According to classical circumstances, after the acquisition of valuable real estate in the center of Kiev in 2016, a client of Lavrynovych & Partners Law Firm received a lawsuit in 2019 aimed at depriving him of this property.
The plaintiff, who previously owned the disputed property, referred in his claim to a violation of the foreclosure procedure on real estate, which was the subject of a mortgage agreement.
In particular, they talked about non-compliance with the 30-day deadline for a possible start of the procedure, as well as the absence of a fact with confirmation of his debt on the main monetary obligation.
The Shevchenkivskyi District Court of the city of Kiev, in its decision dated 06.10.2020, agreed with the lawyers of the Firm on the enforcement of the provisions of the regulatory legislation of Ukraine and the lack of legal grounds for satisfying claims. Having recognized the client as a bona fide purchaser of the disputed property, the court completely dismissed the claim.
In court, the interests were defended by a team of lawyers led by Associate Partner Artur Kiyan.

Thus, based on the results of an unscheduled audit carried out in 2018, the Department for State Architectural and Construction Control of Kyiv (SACC) drew up a resolution to impose a fine on the Firm’s client for violations in the field of urban planning.
The essence of the claims of the supervisory authority was in alleged violations of building codes and regulations during construction work on the reconstruction of non-residential premises.
Satisfying the claims for the cancellation of the SACC resolution on the imposition of a monetary fine, the local administrative court agreed with the lawyers of Lavrynovych & Partners Law Firm about the illegality of such a resolution and the absence of legal grounds for bringing the client to responsibility.
On September 28, 2020, the said court decision was upheld by the decision of the Sixth Administrative Court of Appeal.

Artur Kiyan, associate partner of Lavrynovych & Partners Law Firm, announced the modern ways of anti-raider response. According to the speaker, the legislation does not distinguish the term “raiding,” but it can be defined as an unlawful takeover of the company or the establishment of another way to control the company’s assets against the will of the owner. The concept of raiding evolves in connection with the appearance of gaps in the legal field – the legislator cannot foresee and eliminate all the possibilities for abuse. Arthur Kiyan singled out such modern methods of raiding as falsification, theft of documents and seals, the use of lost passports of individuals, court decisions, corruption and the use of force.
Speaking about preventive ways to prevent raiding, Mr. Kiyan named separation of business from assets and their use through leasing, balancing the corporate structure, proper legal execution of all corporate documents, in particular, bringing statutory documents in accordance with new legislation, server protection , information security, monitoring the situation around the company, physical security. In order to counter capture or unlawful takeover, a situation should be assessed or information on the aggressor, the customer, their goals and possible resources should be collected, and preventive measures should be taken to protect against raider attacks, if they were not used before.
