Lavrynovych & Partners Law Firm successfully defended the interests of its client, a Ukrainian manufacturer, in the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry in a dispute with a supplier from the Czech Republic.
Thus, under the contract, the foreign supplier undertook to deliver fish products of Peruvian origin to Ukraine via the seaport of Klaipėda (Republic of Lithuania).
Delivery was made on CFR terms in accordance with INCOTERMS 2020.
However, the delivered products did not meet the agreed international quality standards, as proven by the lawyers of Lavrynovych & Partners Law Firm during the arbitration hearings.
By its decision in favor of the Firm’s client, the ICAC at the UCCI collected the full amount of the advance payment and satisfied the claims for damages.

According to classical circumstances, after the acquisition of valuable real estate in the center of Kiev in 2016, a client of Lavrynovych & Partners Law Firm received a lawsuit in 2019 aimed at depriving him of this property.
The plaintiff, who previously owned the disputed property, referred in his claim to a violation of the foreclosure procedure on real estate, which was the subject of a mortgage agreement.
In particular, they talked about non-compliance with the 30-day deadline for a possible start of the procedure, as well as the absence of a fact with confirmation of his debt on the main monetary obligation.
The Shevchenkivskyi District Court of the city of Kiev, in its decision dated 06.10.2020, agreed with the lawyers of the Firm on the enforcement of the provisions of the regulatory legislation of Ukraine and the lack of legal grounds for satisfying claims. Having recognized the client as a bona fide purchaser of the disputed property, the court completely dismissed the claim.
In court, the interests were defended by a team of lawyers led by Associate Partner Artur Kiyan.

Thus, based on the results of an unscheduled audit carried out in 2018, the Department for State Architectural and Construction Control of Kyiv (SACC) drew up a resolution to impose a fine on the Firm’s client for violations in the field of urban planning.
The essence of the claims of the supervisory authority was in alleged violations of building codes and regulations during construction work on the reconstruction of non-residential premises.
Satisfying the claims for the cancellation of the SACC resolution on the imposition of a monetary fine, the local administrative court agreed with the lawyers of Lavrynovych & Partners Law Firm about the illegality of such a resolution and the absence of legal grounds for bringing the client to responsibility.
On September 28, 2020, the said court decision was upheld by the decision of the Sixth Administrative Court of Appeal.
In court, the client’s interests were represented by a team of lawyers led by Associate Partner Artur Kiyan.
