Iryna Marushko, Partner of Lavrynovych & Partners Law Firm, participated in the Korean-Ukrainian Business Forum held in Kyiv on September 30.

The Forum’s agenda included speeches by the Prime Minister of the Republic of Korea Kim Hwan Sik and Ukrainian officials. The participants of the meeting discussed economic reform programs of Ukraine in the context of cooperation with the IMF, Korea’s reforms as a strategy of overcoming the crisis, creation of a free trade zone between Ukraine and the European Union and prospects of a free trade zone between the Republic of Korea and the EU.

Lavrynovych & Partners Law Firm and Alfa-Bank, a member of the Alfa-Group international consortium, signed a cooperation agreement on September 28. This project will be implemented by a team of lawyers supervised by Stanislav Skrypnyck, Partner of Lavrynovych & Partners.

Alfa-Bank (Ukraine), a universal commercial bank, holds leading positions in all segments of the Ukrainian banking market. According to statistics of the National Bank of Ukraine, the Bank was among the country’s top 10 banks in terms of assets and one of the leaders in terms of legal entities’ funds attracted and the growth rate of the retail deposit and credit portfolios in 2011.

Stanislav Skrypnyck, Partner of Lavrynovych & Partners Law Firm, and Senior Associate Andriy Moroz took part in the 7^thInternational Forum «Fuel and Energy Complex of Ukraine: Present and Future», which opened in Kyiv on September 20.

The major topics of the Forum’s business program this year included: the coal industry development prospects, energy efficiency in Ukraine, problematic issues of electric energy’s quality assurance and control, reforms in the oil & gas industry of Ukraine, legal support of the fuel and energy complex activities.

The speakers at the conference were managers of the Ministry of Energy and Coal Industry of Ukraine, representatives of Oblenergo, Energoatom NNEGC, Ukrenergo NEC, Energy Company of Ukraine, Ukrhydroenergo, Ukrhydroproject PJSC, OJSC «Turboatom», Ukrtransgas AC, Gastransit JSC, Chernomorneftegas NJSC, and KYIVENERGO Public Joint Stock Company. Over 200 top managers of energy companies from ten countries participated in the conference, including Germany, the Czech Republic and Russia.

Maksym Lavrynovych, Managing Partner of Lavrynovych & Partners Law Firm, made a speech entitled «Abuse of Power by Advocates and Liability for Non-Compliance with the Rules of Advocates’ Ethics» at the Ukrainian Advocates Association’s 1^stAnnual Forum held in Kyiv on September 20.

In his speech, Maksym Lavrynovych identified the main types of advocates’ abuse: acting in their own interests or in the interests of third parties; using unethical practices while handling their assignments; influencing or coercing adverse parties, witnesses, court or other authorities; disclosure of confidential information; protracting a case contrary to their client’s interests and unfair practices applied by advocates in handling their assignments.

Maksym Lavrynovych believes that the professional standards of advocate’s activity can be increased by establishing an efficient and effective mechanism for bringing an advocate to liability. Mr. Lavrynovych put forward a proposal to combine the disciplinary practice of the regional Qualification and Disciplinary Commissions of Advocates and Higher Qualification Commission of Advocates and introduce a uniform system of criteria to evaluate the extent of violation of moral and ethical principles by advocates in a disciplinary proceeding.

On September 20, 2011, lawyers of Lavrynovych & Partners successfully represented the interests of Ukragroalliance LLC in the case regarding the claim lodged by Ukragroalliance LLC against the State Tax Inspection (STI) of Holosiyivsky District in Kyiv seeking invalidation and reversal of tax notification decisions on reducing the budget refund of VAT in the amount of UAH 439,782 and imposing fines totaling UAH 109,945.

The resolution of the District Administrative Court of Kyiv City fully satisfied the claim filed by Ukragroalliance LLC.

Iryna Marushko, Partner of Lavrynovych & Partners Law Firm, and Senior Associate Olena Zubchenko attended the II International Conference «Large Farm Management», which took place in Kyiv on September 15. The Conference was supported by the Ministry of Agricultural Policy and Food of Ukraine, Institute of Agricultural Development in Central and Eastern Europe (IАМО) and Committee on Eastern European Economic Relations.

The key speakers at the Conference were heads of the largest agricultural companies of Brazil, Argentina, Russia, Kazakhstan and Ukraine, as well as Klaus Deininger, a Lead Economist at the World Bank. The issues addressed at the Conference included: transnational activity of agricultural enterprises, the importance of entering foreign loan markets, vertical integration in agribusiness of Ukraine. The Conference welcomed 250 entrepreneurs, top managers and researchers from 15 countries, including UK, Germany and Israel.

Roman Blazhko, Senior Associate at Lavrynovych & Partners, participated in the Second Annual Conference “Tax and Customs Litigation 2011: Winning the Battle” organized by PwC Ukraine in Kyiv on September 5.

At the conference were discussed changes in the judicial system and tax legislation, possibilities to challenge the decisions of the Highest Administrative Court of Ukraine to the Supreme Court of Ukraine, criminal prosecution in the context of disputes with the Tax Authorities, disputes with Customs Authorities and the draft Customs Code of Ukraine.

Lavrynovych & Partners has represented the interests of Ukrainian dairy producer Galakton PJSC in Ukrainian courts in a case based on a claim brought by the Kyiv environmental prosecutor in the interests of the state represented by the State Environmental Inspectorate seeking damages of UAH 5,753,801.16 caused to the state by a breach of the terms of a special water use permit.

On 31 August 2011 the Higher Commercial Court of Ukraine upheld the resolution which was issued by the Kyiv Appellate Commercial Court on 16 June 2011 and which overturned the decision of the first instance court to recover UAH 5,753,801.16 from Galakton PJSC for the benefit of the state and dismissed the claim.

Managing Partner of Lavrynovych & Partners, Maksym Lavrynovych, has made his debut on the list of Top 25 Ukrainian Lawyers in the annual survey “Ukrainian Law Firms 2011” published by the legal weekly Yuridicheskaya Praktika.

“This year our firm has set a new Ukrainian record for the total amount of tax disputes won for one client: over UAH 1bn in the first six months of the year,” said Maksym Lavrynovych.

Under an agreement with the international law firm White & Case, Lavrynovych & Partners has advised the Ukrainian Finance Ministry in the process of negotiating and signing a guarantee agreement for a USD 372,313,538 loan obtained by the state-run Directorate for Construction and Management of National Project “Air Express” and by other Kyiv regional infrastructure facilities from the Export-Import Bank of China.

The loan will be used to implement a project involving the construction of a high-speed railway line between Kyiv and BoryspilInternational Airport and a loop road around Kyiv.
