Lavrynovych & Partners Law Firm has successfully represented the interests of a client, the owner of one of Ukraine’s leading machine-building enterprises, in the case regarding a claim filed against the founder of the newspaper “Dzerkalo Tyzhnya. Ukraine” seeking protection of honor, dignity and business reputation, as well as recognition of the distributed information as inaccurate and refutation of such information.

On January 10, 2012, the Pechersky District Court of Kyiv issued a ruling according to which the information distributed by the defendant was recognized as inaccurate and found discrediting honor, dignity and business reputation. The Court also ordered that a relevant refutation be published by the defendant within a month.

Legal support for the lawsuit was provided by Artur Kiyan, associate of Lavrynovych & Partners, under the supervision of the Firm’s Partner Stanislav Skrypnyck. In 2011, Lavrynovych & Partners actively developed its court practice related to defense of public persons’ right for respect of honor and dignity: the Firm’s associates and Partners handled a series of successful cases, secured publication of refutations in mass media and compensation for moral damages.

Lavrynovych & Partners Law Firm acted as a Ukrainian law adviser in the process of providing state guarantees for raising an $85,000,000 long-term loan facility to reconstruct and modernize the mines of LisichanskUgol OJSC.

The loan agreement was signed by China Development Bank, a state-run Chinese bank, and the Ministry of Finance of Ukraine on December 28, 2011. This is the first time in history that China Development Bank has extended a loan to a Ukrainian enterprise.

According to the agreement with LisichanskUgol OJSC, Lavrynovych & Partners Law Firm provided legal support during the negotiation and execution of the guarantee agreement. White & Case International Law Firm acted as a legal adviser for the Ministry of Finance of Ukraine.

Lavrynovych & Partners Law Firm has successfully defended its client’s land interests at the Melitopol City District Court of Zaporizhya Oblast in a case regarding the recognition as unlawful and reversal of a resolution adopted by a governmental authority.

By its ruling, on 16 December the court supported the legal view of Lavrynovych & Partners’ lawyers regarding the illegality of refusal to extend the term of agreement on lease of a land plot for construction of a trade center, and reversed the city council’s resolution.

When preparing the ranking, researchers and journalists of International Tax Review interviewed finance directors in 56 countries.

Iryna Marushko, Partner of Lavrynovych & Partners Law Firm, made a speech at the International Fiscal Association (IFA)’s Regional CIS International Tax Conference held in Kyiv on December 5-6.

In her speech entitled «Tax Treaties: General Overview of Major Issues in Interpretation and Application of Tax Treaties», Iryna Marushko covered the following issues: avoidance of double taxation within the Ukrainian legal system and problems of court practice.

The Conference included a session of the Governmental Panel with the participation of tax officials from the CIS countries and IFA managers.

Iryna Marushko is a board member of the International Fiscal Association since 2008.

Lavrynovych & Partners Law Firm represented in the High Specialized Court of Ukraine for Civil and Criminal Cases the interests of a client in a case for recovery of non-accrued and unpaid interest exceeding UAH 540,000 under an agreement from a commercial bank.

Maksym Lavrynovych, Managing Partner of Lavrynovych & Partners Law Firm, delivered a speech at the conference called «Ukraine, where are you heading to?», which took place on December 5 in Lugano, Switzerland.

In his speech entitled «Legal Aspects of Foreign Trade and Investments in Ukraine», Maksym Lavrynovych covered the following issues: foreign investment registration procedure in Ukraine, tariff and non-tariff regulation, the existing investment restrictions and ways of resolving investment-related disputes.

The conference was held by the Ticino Chamber of Commerce and Industry in partnership with OSCE, Credit Suisse and the Embassy of Ukraine in the Swiss Confederation.

Lavrynovych & Partners Law Firm has successfully defended at the District Administrative Court the interests of Chornobayivske hunting enterprise, one of Ukraine’s largest lessees of land, during the hearing of a case regarding the recognition as unlawful and reversal of a resolution adopted by a government agency.

The District Administrative Court has, by its judgment, supported the legal view of Lavrynovych & Partners lawyers regarding the unlawful nature of the Oblast Council’s decision to satisfy the prosecutor’s protest and subsequent reversal of its own decision, whereby lands and areas were leased out to the Firm’s client.Legal support for the project was provided by Partner of Lavrynovych & Partners Law Firm Stanislav Skrypnyck and associate Artur Kiyan.
