Lavrynovych & Partners Law Firm successfully defended in court the interests of its client, who works in the agricultural sector of Ukraine.
A dispute arose over the counterparty’s refusal to refund the client for services that were never provided.
The unscrupulous counterparty believed that there were no legal grounds for returning the funds, since the concluded agreement could not be terminated due to the martial law imposed in Ukraine and could be performed after its cancellation.
However, lawyers at Lavrynovych & Partners Law Firm proved that the legal regime of martial law significantly changed the circumstances of the previously concluded agreement, which could no longer be fulfilled.
The Commercial Court of Cherkasy Region agreed with our legal position and fully satisfied the claim for termination of the contract and recovery of funds in favor of the client. This decision was deemed justified and left unchanged by the courts of appeal and cassation.
