Legal assistance within the journalistic investigation «Country May to Know”

Tetyana Kaftya, associate with «Lavrynovych and Partners» Law Firm, commented on the application of the international private law and mechanisms of rights protection of Ukrainian citizens who reside abroad, in context of a resonance journalistic investigation «Country May to Know “, initiated by journalists of the ICTV channel.

The investigation related to the case of Ukrainian woman Nataliya Shapachynska. The Juvenile Court of Milan (Italy) has restricted her exercising of parental power by its Decree, on January 21, 2010. By this Decree, Vladimir Serhiyenko, Nataliya’s two-year-old son who is a citizen of Ukraine, was placed in Italian foster home.

Tetyana explained to journalists the issues related to the intercountry adoption and fostering, the determination and nature of the governing law, according to the current international contracts and conventions in the sphere of the family law. Also, associate of our firm, paid a special attention to the significance, functions and obligations of Ukrainian Consular and Diplomatic Institutions, existing mechanisms of bringing such officials to liability for their decisions, actions and/or omissions which were prejudicing for a citizen of Ukraine.
