On 17 April Lavrynovych & Partners in cooperation with Conference House held the Business-breakfast «Mergers & acquisitions in Ukraine. Questions of the antimonopoly regulation».

Judging by the number of participants, the questions contemplated during the business-breakfast are of vital importance for a great deal of Ukrainian and international companies working in Ukraine. The questions raised in course of the event can often become a stumbling block for company’s restructuring or merger.

The experts on antimonopoly regulation of M&A were Maksym Lavrynovych – Managing Partner at Lavrynovych & Partners, and Yuri Radzievsky – senior associate.

The questions on the monopolization, concentration and different aspects of obtaining the permit of the Antimonopoly Committee of Ukraine (AMCU) on concentration were canvassed in course of the Business-breakfast. Participants discussed a commonly encountered problem of what is considered as a concentration and what is not; who is considered as a participant of concentration and who is not; when obtaining the permit of the AMCU on concentration is required.

Speakers also gave consideration to the procedure of obtaining the permit on concentration, assets acquisition by a non-resident in Ukraine and differences between the competitive activities and anticompetitive coordinated-actions.

In completion of the Business-breakfast the questions on the responsibility for the violation in the field of antimonopoly regulation were discussed.

The Business-breakfast provided participants with exclusive opportunity to share their experience of juridical activity in the field of antimonopoly regulation and to communicate with the key specialists in a friendly atmosphere.

A series of similar events is planned in the foreseeable future for comprehensive examination of legal issues arising in course of M&A.
